Terms of Sale

By placing a request for a driver; you are offering to purchase a service on and subject to the terms and conditions as outlined in your service agreement executed by Ultimate Driver Staffing.

All requests are subject to availability and confirmation of the driver. Dispatch times may vary according to availability. Ultimate Driver Staffing reserves the right, without prior notification, to limit the request quantity and/or to refuse service to any customer. Verification of information for factoring purposes may be required prior to the acceptance of any driver requests.

Rates and availability of drivers are subject to change, possibly without notice. Errors will be corrected when discovered, and Ultimate Driver Staffing reserves the right to revoke any stated offer and to correct any errors, inaccuracies, or omissions (including after an invoice has been submitted).

Indemnification

You agree to indemnify, defend and hold us and our successors and assigns harmless from and against and in respect of any and all third party claims, demands, losses, costs, expenses, obligations, liabilities, damages, recoveries, and deficiencies, including interest, penalties, and reasonable attorneys’ fees that we shall incur or suffer which relate to the website, your failure to perform any of your obligations under these Terms of Use, or your breach of any of your representations or warranties made under these Terms of Use.

Entire Agreement

The above Terms of Service constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and Ultimate Driver Staffing. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by the President of Ultimate Driver Staffing.
